BP Oil Spill Claims

Ken Stein is an attorney who has practiced law in the areas of tort and business litigation for more than 33 years, having been first licensed to practice law in the State of Texas in 1976. Our principal office is located in Dallas, Texas, though we have represented clients in various courts throughout the United States.  Mr. Stein is currently representing other property owners with claims against British Petroleum, et al., as a result of damages caused by the Oil Spill.  Payment for the legal services provided by our firm in such matters is based on a contingency fee arrangement.  This means that the fee for legal services would be a percentage of the net recovery in this case, due and payable upon and in the event of a recovery.  Our fee would be twenty percent (20%) of the net recovery, but the fee could be lower as explained in the next paragraph.  In addition, we would retain in full all court awarded attorney's fees, if any, which are collected.

We may represent more than one claimant or property owner in connection with the Oil Spill, also on a contingency fee basis.  If so, we will pursue all such claims equally, on a pro rata basis.  In addition, our contingency fee percentage will vary, depending upon a total number of property owners we represent (for this purpose, the multiple owners of a single parcel of real property shall be considered to be one claimant).  If we represent, in total, 100 to 200 claimants, our fee will be nineteen percent (19%) of the net recovery.  If we represent 201 to 300 claimants, our fee will be eighteen percent (18%) of the net recovery.  If we represent 301 to 500 claimants, our fee will be seventeen percent (17%) of the net recovery.  If we represent 501 to 1000 claimants, our fee will be sixteen percent (16%) of the net recovery.  If we represent more than 1000 claimants, our fee will be fifteen percent (15%) of the net recovery.  As used herein, "net recovery" is defined as the sum of any money, compensation, value or benefit (excluding court awarded attorney's fees) paid or provided by the opposing party or parties, less reimbursement of all costs of litigation to the party advancing same.

In addition to the contingent fee, we will advance all costs of litigation, as these costs are incurred.  As used herein, "costs of litigation" is defined as any and all reasonable expenditure incurred in connection with the handling of this case.  These costs include, without limitation, court costs, expert witness fees, special postage, filing fees, deposition costs, long distance charges, delivery charges, copy charges, facsimile transmission charges, computer research and information retrieval, and other similar or related expense items pertaining to the handling of this case.
