Our attorneys are committed, in each case, to the most economical solution that is most beneficial to our client, and always consider the merits of alternative dispute resolution, primarily mediation. However, many construction disputes must be resolved through litigation.
Our lawyers represent clients involved in disputes including construction liens, breach of contract, construction bid protests, subcontractor performance bonds, construction accident defense, warranty claims, delay damages, and product failures.
Our client representation includes all matters relating to mechanic’s and materialman’s liens and payment bonds, including state public works (Government Code) and federal public works (Miller Act). Our attorneys prepare the necessary notices, affidavits, and bond claims to perfect the lien/bond or help the client with perfection, depending on the client’s instructions.
When a construction lien or bond is not perfected, we endeavor to collect through other means, such as common law bonds and the Texas Construction Trust Fund Statute. We also assist clients in improving their position when the client is not protected by the Miller Act or other applicable statute. Our lawyers are active in enforcing the lien/bond claims in state and federal courts and when applicable, establishing our client’s lien as prior to other parties’.
